Changes to TERMS

The latest version of the Terms is dated 23rd June 2017. We reserves the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications will be notified to you by email and shall become effective immediately upon such notification regardless on whether you have confirmed receipt. You hereby agree that it is your responsibility to review this agreement on a regular basis to keep yourself apprised of any changes. You can find the most recent version of the Terms here

Law

ProBiometrics Ltd undertakes to meet all of its obligations under the consumer laws currently in force. All Terms and Conditions as detailed here shall be construed and operate in conformity within UK law. These terms shall be read in accordance with any agreement in force between ProBiometrics Ltd and you and shall only be superseded by specific terms and conditions contained within such agreement where specifically stated. You agree that the relevant jurisdiction is the UK and this agreement is regulated within the UK except where National law applies to a particular issue in dispute.

Warranties

Self-diagnosis and treatment using collected results may be dangerous and self-diagnosis can damage your health. Follow the instructions of your physician or licensed healthcare provider. Contact your physician for specific information about your heart condition, blood pressure, Oxygen saturation, body weight or any other collected value or parameter.
ProBiometrics Ltd takes all precautions to ensure the accuracy of results and the quality and workmanship of devices provided. However, ProBiometrics Ltd shall make no warranties as to the accuracy of the results provided and shall not be liable for any action or inaction taken as a consequence of any results provided by ProBiometrics Ltd
Where this service is not provided to a licensed healthcare professional the results are not provided for the purposes of clinical examination and shall therefore not be relied upon in any way for the purposes of clinical diagnosis.
Where this service is provided to a licensed healthcare professional the terms and conditions of the contract in place between you and ProBiometrics Ltd shall take preference as well as the relevant disclaimers and warranties.
Subject to the above, if there is any defect in the devices or the results provided, ProBiometrics ltd will investigate the cause and provide such equipment required while a relevant maintenance contract is in place and limited to the terms of the maintenance contract.

Security

Your information security is important to us. We take every precaution to ensure that this website is safe and that your personal details are protected. However, we do not accept any liability for any breach of security whether by misuse by you or by act or omission by us.

Confidentiality

We will never pass on your email address or details to anyone outside of ProBiometrics except as required for payment processing, delivery purposes, software development and testing, internal and external auditing, regulatory purposes, and where required to by law. Your email address and details are used solely to assist us with communicating with you, operating your account, and payment processing. Indemnity
Users agree to indemnify and hold ProBiometrics ltd, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including all legal fees and court costs, from use of this service or any action or inaction taken by you in reliance on the information provided by this service, or otherwise caused by or through use of the service.

Typographical Errors

In the event a product or service is listed at an incorrect price due to typographical error or other error, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been accepted and your debit or credit card charged. If your debit or credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your debit or credit card account in the amount of the charge and ProBiometrics Ltd liability to you will come thereafter come to an end. No contract shall exist between yourself and ProBiometrics Ltd until the confirmation E-mail is received notifying you that your order has been accepted or has been dispatched.

Payments

All prices are quoted in Pound Sterling unless specifically indicated and exclude VAT. Payment can be made by credit/debit card. We accept Visa, MasterCard, Delta, Solo, and Switch. VAT will be charged on purchase if relevant and invoices will be sent with the delivery.

Warranty

ProBiometrics Ltd takes all precautions to ensure the quality of materials and workmanship against faulty materials and/or workmanship in accordance with all relevant manufacturer’s and supplier’s guarantees and warranties. This warranty applies only to the first user of the goods and is not transferable. ProBiometrics Ltd, under no circumstances, accepts responsibility for defects whatsoever arising from the misuse of any goods or arising out of situations outside the control of the ProbioMetrics Ltd. This guarantee shall not apply to defects in any goods that have been altered by customers, misused or repaired by non-authorised persons.
Subject to the above if, during the subscription period, the customer complains of a defect in the materials or workmanship, ProBiometrics shall warrant to bear the cost of materials needed and the labour used for the replacement or repair of the equipment. ProBiometrics Ltd shall not be liable for any expenses arising from delay in replacing or repairing the equipment under this warranty or for any other losses or expenses incurred by you as a result of the defect. This warranty is on a return to base basis and does not cover carriage either to or from the Company’s premises.
Where damage is caused to equipment loaned or leased to you.

VAT & VAT exemption

All prices are quoted without VAT added. If the products are being purchased by a registered charity or used for exclusively for research purposes, then you may be able to claim VAT exemption. ProBiometrics Ltd will require (before delivery) a faxed copy of your charity details, on headed note paper, stating your charity registration number and signed by a duly appointed responsible person.
If products are being purchased by a VAT registered EU company (excluding UK) then we can refund VAT only if a valid VAT number is provided at the time of purchase together with sufficient company information to allow for VAT refund. This is subject to current UK VAT legislation and may be withdrawn depending on current legislation without notice.
ProBiometrics Ltd reserves the right to charge VAT retrospectively if compliance to the above is not accepted by HM Customs & Excise.

Refunds

Refunds will be made for all orders cancelled within 7 days of ordering, or equipment returned within 7 days of receipt. All goods returned for refund, must be returned in the original box and in perfect condition to ProBiometrics Ltd by insured post at the sender’s expense. If equipment provided was faulty, ProBiometrics Ltd will refund all postage costs. Claims for damaged goods or mishandling must be made within 7 days of receipt of the product. After this period a replacement fee will be charged.

Cancellations

All cancellations must be made in writing, either by email, fax or letter within 24 hours of ordering. If a cancellation is not received within 24 hours of ordering, we may at our discretion, upon receipt of our equipment unopened and in its original packaging within 7 days allow a full refund. Please refer to our refund conditions for more detailed information on our refund policy and the restocking fee.

General

Prices and manufacturers specifications are subject to change without notice. ProBiometrics Ltd is not liable for the accuracy, availability, completeness or usefulness of any of the information accessible on or via this web site or whether the information is up to date. You are responsible for protecting the security and integrity of your system and data. ProBiometrics Ltd makes no claim that this web site is free from viruses or other computer or data corrupting or damaging material.

Delivery

Delivery will normally take place within 3 – 10 working days. In the event that an order takes longer than 10 days to dispatch, we will notify you. Delivery will be sent to the address provided by you at the time of ordering through UPS. ProBiometrics Ltd will not be held responsible for any difficulties that may occur with a delivery as a result of incorrect delivery details being supplied. As UPS normally delivers orders during office hours, some clients find it easier to provide their work address for delivery. If you are not home when UPS attempts to deliver your order, they will leave a calling card for you and attempt to re-deliver the item on the next day. If they are still unable to reach you, UPS will take your order to the nearest UPS depot where you can collect your order at your convenience. If the parcel is not collected within this time, it will be sent back to ProBiometrics Ltd. Therefore, redelivery will cost an additional fee. UPS does not deliver on Saturdays.

Items unavailable or out of Stock

If equipment is not in stock, a member of our team will contact you to let you know when you can expect delivery.

Export Restrictions

There are currently no export restrictions on all our products and services. We have in place product approval in many countries as specified on the product page. It is your responsibility to ensure approval is in place for the use intended in the country of purchase.
